Terms and Conditions

These Terms and Conditions ("Agreement") are entered into by and between Qoowat Services LLC ("Company", "we", "our", or "us") and the client ("Client", "you", or "your") who purchases our marketing services and/or software access. By using our services, you agree to these terms.

1. Company Information

Qoowat Services LLC. is a Limited Liability Company (LLC), A Registered Company in North Carolina, USA. We only serve U.S.-based testosterone replacement therapy (TRT) clinics.

2. Services Provided

We provide comprehensive digital marketing services to TRT clinics, including web design, paid advertising, branding, SEO, animation, content creation, SMS/email marketing, social media management, AI chatbot integration, and more. We also provide access to our white-labeled GoHighLevel marketing software.

3. Service Plans

Done-For-You Offer: 12-month contract required. Includes all services and software access. Done-With-You Offer: Month-to-month access to our software, live Zoom training. No contract required.

4. Software Access & Use

Access is granted only while payments are active. Clients must not spam or misuse the platform. All communication with leads/patients must occur through our platform. Clients are responsible for maintaining A2P registration for SMS campaigns.

5. Payment Terms

All payments via debit/credit card through our portal. Done-for-you: Flat monthly retainer with a 12-month contract. Refund if 10 patients do not show up in month one (if $50/day ad spend is met and CRM protocols are followed). Done-with-you: Monthly subscription. Cancel anytime.

6. Ad Spend

Client must set up separate billing for ad platforms (Facebook, Google, TikTok, etc.) using their own cards. Minimum required ad spend for guarantee: $50/day.

7. Ownership & Intellectual Property

Qoowat Services LLC retains all rights to creative assets, software configurations, automation sequences, content, ads, copywriting, images, and videos unless specifically created and submitted by the client.

8. Data Handling & HIPAA Compliance

We handle patient data securely and can enable HIPAA-compliant features upon request. Clients must use the platform to document appointment attendance for guarantee eligibility.

9. Cancellations & Refunds

Done-for-you offer: 12-month term, but cancelable after 3 months with 14-day notice. Refunds for the first month only if guarantee requirements are met and not fulfilled. Done-with-you: Cancel anytime via platform.

10. Restrictions

Clients may not engage in unlawful activity, spam, abuse system resources, or attempt to hire/solicit Company employees or contractors.

11. Dispute Resolution

All disputes will be resolved by binding arbitration through the American Arbitration Association. If unresolved, matters may be pursued in small claims court in North Carolina. This Agreement is governed by the laws of the State of North Carolina.
